Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that Obama and tbe DNC “ADMITTED”, by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit. Obama is “NOT QUALIFIED” to be President and therefore Obama must immediately withdraw his candidacy for President and the DNC shall substitute a qualified candidate. The case is Berg v. Obama, No. 08-cv-04083.
Berg stated that he filed Requests for Admissions on September 15, 2008 with a response by way of answer or objection had to be served within thirty [30] days. No response to the Requests for Admissions was served by way of response or objection. Thus, all of the Admissions directed to Obama and the DNC are deemed “ADMITTED.” Therefore, Obama must immediately withdraw his candidacy for President.
OBAMA - Admitted:
1. I was born in Kenya.
2. I am a Kenya “natural born” citizen.
3. My foreign birth was registered in the State of Hawaii.
4. My father, Barrack Hussein Obama, Sr. admitted Paternity of me.
5. My mother gave birth to me in Mombosa, Kenya.
6. My mother’s maiden name is Stanley Ann Dunham a/k/a Ann Dunham.
7. The COLB [Certification of Live Birth] posted on the website “Fightthesmears.com” is a forgery. The Federal Election Commission has joined Barack Obama and the Democratic National Committee in asking a federal judge to dismiss a lawsuit filed by a Montgomery County attorney seeking Obama's ouster from the November ballot.
Philip Berg, who claims the Illinois senator was born in Kenya and can't run for president because he isn't a natural-born U.S. citizen, has no standing to make the claim, according to the FEC.
The motion, filed Tuesday in U.S. District Court in Philadelphia, echoes one filed last month by Obama and the DNC that states Berg hasn't demonstrated how he personally would suffer even if his ''ridiculous and patently false'' claims were true.
The FEC says Berg would have to claim a ''concrete and particularized'' injury. But he ''has done nothing more than assert a generalized grievance on behalf of the American citizenry and his fellow voters,'' and courts have tossed claims made on behalf of ''such all-encompassing groups.''Berg, of Lafayette Hill, sued Obama in August, also naming the DNC and the commission.
The FEC says it should be dismissed as a defendant even if Berg had standing because ''it has no power to determine who qualifies for ballot access or who is eligible to serve as president.''Earlier this year, after sustained pressure from the U.S. media, a select team of reporters was allowed limited access to John McCain's medical records at forty-eight hours notice. The former naval pilot, who has had four bouts with cancer, allowed the reporters three hours to view his 1,173 page file, which only related to his medical history for the previous eight years. Only one of the reporters, Sanjay Gupta, health correspondent for CNN, had any previous medical knowledge.
The snapshot into the Republican presidential nominee's health records revealed he enjoys good health for a septuagenarian, however the fact that the 72-year-old McCain will be the oldest first time President to be inaugurated if his candidacy is successful, has yet again put his health front and centre as a campaign topic particularly with his selection of the combative, yet wholly inexperienced, Governor of Alaska Sarah Palin as vice-presidential candidate.
Now a group of doctors, who support the candidacy of McCain's rival Sen. Barack Obama, have called on the Arizona senator to release his full medical records to the public saying the American people require full accountability before they make their decision on Election Day.
Though showing no sign of any fitness concerns having set a blistering pace on the campaign trail, the doughty Arizona senator has had a history of health problems.
"John McCain is a 72 year old man with recurrent melanoma, hyperlipidemia, degenerative joint disease, and recurrent difficulty with certain efforts at recall", a letter to Doctors For Obama states.
"These are the limited facts the American people have had access to. Over 1000 pages of medical records were shown to selected journalists for 3 hours with less than 48 hours of notice."
Pointing out that a serious repetition of previous medical disorders could seriously affect his presidency even the possibility of it resulting in his death, the letter continues.
...A recurrence of metastatic malignant melanoma would essentially destroy John McCain's capacity as the Chief Executive, and the American People have yet to receive a full accounting of the facts regarding his actuarial risk.
While the thought of any President dying in office is an eventuality no one would wish to contemplate, does the letter touch on an important and perhaps obvious right of American voters -- to have all the relevant information at their disposal before a candidate runs for the highest office in the land? Should candidates be required by law to release health records or should privacy concerns prevail?
The point is made by the doctors that the Army scrupulously vets the health of its members prior to engaging them, why shouldn't the same standards be applied to the person seeking the presidency?
The qualification to be president is:
Tabacco, the point I am making is all Obama has to do is show the official
"vault copy" of his birth certificate and prove he has the Constitutional
right to be President. Obama is a Constitutional scholar and presumably has
great respect for the Constitution. Or maybe not? McCain should show his
recent physical and mental health records. What is he hiding? Psychiatric
medicine? Presidents having secrets is part and parcel of "Washington
politics". Is Obama and McCain, the change we really need? I am a third
party advocate because the Republican and Democratic parties have become a
"duopoly" controlled by the the Fed and the international banking cartel.
Obama and Mccain are just two sides of the same coin, as I see it. Thanks
